DUI Law in Pennsylvania
The repercussions associated with DWI and DUI charges can be very harsh in the state of Pennsylvania. Penalties depend on how many prior convictions the drive possesses, as well as his or her blood alcohol content (BAC) at the time of the arrest. The most leniency is granted to first-time offenders with a BAC of between 0.08 and 0.10 percent. These drivers do not face license suspension, but they are put on probation for a minimum of six months. Additional consequences include $300 fines and, in some cases, drug and alcohol (D&A) assessments.
For a second arrest with a BAC between 0.08 and 0.10, the driver is required to spend between five days and six months in jail. These penalties steadily increase in severity as the BAC and number of prior DUI convictions increase. Following four DUI convictions in a ten-year period, the driver may face up to five years in prison, eighteen months of license suspension, and one year of driving with an ignition interlock device.
Accelerated Rehabilitative Disposition
Some of the aforementioned DUI penalties can be avoided through participation in Pennsylvania’s Accelerated Rehabilitative Disposition (ARD) program. In order to be eligible, the offender must not have a prior history of DUI, and must not have seriously injured or killed anybody else while driving under the influence. Following successful completion of the program, the participant’s record may be expunged.
